Lifecycle of Trademark Registration in India

Below are the stages of the trademark registration process in India. 

S.No Stages of a Trademark Application Estimated timeline for each stage*
1 Vienna Codification
(Every non-text trademark is assigned with codes as per the Vienna Convention)
0.5 – 2 months since Trademark filing
2 Formalities Check Pass/Fail**
(This means that there has been an initial acceptance/refusal of your Trademark Application on technical grounds which can be easily overcome)
1 - 3 months since Trademark filing
3 Marked for Exam
(The Trademark has been sent to the Government appointed examiner for inspection and is pending review)
1-6 months since Formalities Check Pass stage
4 Examination report & its Response**
(It’s a stage wherein the TM Registry raises some questions/objections in regards to the trademark. We are required to file a detailed response to the same at the earliest)
1.5 - 10 months since Marked for Exam
5 Hearing**
(It’s a stage wherein the lawyer will argue the merits of the trademark before the Hearing Officers of Trademark Registry for removing the objections)
7-16 months- from date of examination. For each subsequent hearing to take place it will take around 2-7 months from the previous hearing.
6 Accepted & Advertised
(The trademark is published in the Indian Trade Mark Journal once trademark has overcome any objections of TM Registry. It is published in the journal for 4 months for any third party to oppose if any issue)
If published directed by response to examination report: 2- 6 months
If published after hearing: 0.5-3 months after hearing
7 Registration
(Once the trademark is registered, we will be sending you the Registration Certificate.)
2-10 months after expiry of 4 months of publication period.

Note:If any third party opposes your trademark once the trademark is accepted and advertised by TM Registry, the period of the registration will extend until the opposition is resolved and final order is passed. Also, if you intent to contest the opposition, there will be additional charges levied.

 

The Registry will normally takes over 2 years to grant the Registration due to the heavy back log of files. Once the application is granted, you can start using the ® next to your trademark (name / logo).
