Copyright Registration in India
In India, copyright registration provides its owner, exclusive and individual rights to distribute, replicate and reproduce their work. He can also give consent to another entity, for the same purpose. Registering for copyright provides certain rights like communicating to the public, rights of reproduction, adaptation, and translation of the work.
Basic Requirements for Copyright Registration:
-Basic Details of Candidate
Basic details like the Name, Address, and Nationality of the candidate are required, before registration.
-Soft Copies & CD's
A soft copy of his/her work should be made and all files created in JPEG, JPG, or GIF format.
- Power of Attorney
If a candidate is registering for copyright through an authorized firm or an advocate, it is imperative to have the power of attorney duly signed by the candidate.
Registering for copyright has its benefits. It helps in the creation of intangible assets which can be traded, franchised, or commercially contracted.
The step-by-step process for Copyright Registration in India
To register for copyright, the following steps are followed:
Step 1: The copyright registration application needs to be filed in the concerned forms along with the copyright registrar, mentioning the particulars of the work. Separate copyright applications need to be filed, based on the type of work.
Step 2: The form has to be duly signed by the applicant and must be submitted by the Advocate, under whose name the Power of Attorney is executed. The copyright registration application will then be prepared by our experts and will submit the required forms with the Registrar of Copyrights, electronically.
Step 3: As soon as the application is submitted online, a Diary number will be issued to you.
Step 4: There will be a waiting period of 30 days within which the Copyright examiner will review the application to check for any potential discrepancies or objections.
Step 5: In case, any discrepancy or objection is found, a notice will be issued and the same needs to be complied within 30 days, from the date of issuance of the notice.
Step 6: Once the discrepancy or objection is removed or if no discrepancy or objection is found in the application, the copyright is registered. Once done, the copyright office will issue the Excerpts of the Register of Copyright (ROC), which is the Registration Certificate.
